Please read these terms carefully before using our services

By using Vexa.host’s services (“we”, “us”, “our”), you (“customer”, “you”) agree to these Terms of Service. If you do not agree, you may not use our services.

1. Services

  1. Scope of Services
    Vexa.host provides game server hosting services, including but not limited to Minecraft servers.

  2. Hosting Providers
    Hosting may be provided through third-party data centers, including Hetzner Online GmbH, OVH Groupe SA, or other providers, in compliance with applicable laws.

  3. Service Availability
    Service availability may vary due to maintenance, upgrades, or unforeseen technical issues. While we strive for uninterrupted service, we do not guarantee it.

2. Account and Registration

  1. Accuracy of Information
    You must provide accurate and complete information when creating an account.

  2. Account Security
    You are responsible for the confidentiality of your account credentials and all activity under your account.

  3. Single Account
    Each customer may maintain only one account. Multiple accounts are prohibited.

  4. Age Requirement
    You must be at least 18 years old or have the consent of a legal guardian to use our services.

3. Payment and Fees

  1. Fees
    Fees are displayed on our website and may change with notice.

  2. Payment Provider
    Payments are processed exclusively via the payment service provider Mollie B.V. Non-payment may result in suspension or termination of services.

  3. Payment Terms
    All payments must be made in advance. Refunds are generally not provided, except as required by law or explicitly agreed in writing.

  4. Payment Responsibility
    You are responsible for ensuring your payment information is accurate and up to date.

4. Acceptable Use

  1. Prohibited Activities
    You agree not to use our services for illegal activity, including but not limited to:

    • Distributing malware or viruses
    • Hosting copyrighted material without authorization
    • Harassment, threats, or other abusive behavior

  2. Content Responsibility
    You are responsible for all content hosted on your server. Vexa.host is not liable for user-generated content or player actions.

  3. Cheating & Hacking
    Servers used for cheating, hacking, or exploiting game mechanics are prohibited.

  4. Game Terms Compliance
    You must comply with the Terms of Service of the games hosted, including but not limited to Mojang/Microsoft TOS for Minecraft.

  5. Violations
    Violations may result in immediate suspension or termination of your account without refund.

5. Server Management

  1. Administrative Control
    Customers have administrative control over their servers, within hosting limitations.

  2. Backups
    You are responsible for backing up your server data. Vexa.host may provide backup services but is not liable for data loss.

  3. Maintenance & Security
    Vexa.host may perform maintenance or emergency interventions to ensure server stability and security.

  4. Unauthorized Access
    Unauthorized access to our infrastructure, other users’ servers, or administrative systems is prohibited.

6. Single Account & Prohibited Content Enforcement

  1. One Account Rule
    Each user is limited to one account. Multiple accounts violate this TOS.

  2. Prohibited Content
    Prohibited content includes, but is not limited to:

    • Cheating or hacking tools
    • Pirated or unauthorized software
    • Adult content or illegal materials
    • Malware, viruses, or harmful scripts

  3. Enforcement
    Violation of sections 6.1 or 6.2 may result in immediate and automatic deletion of your account and all hosted data, without notice and without refund.

  4. Investigation Rights
    Vexa.host reserves the right to investigate suspected violations and take enforcement action at its discretion.

7. Termination of Services

  1. Termination by Vexa.host
    Vexa.host may terminate or suspend your account at any time, for any reason, with or without notice.

  2. Termination by Customer
    You may terminate your account at any time by contacting support.

  3. Data Deletion
    Upon termination, all server data may be deleted. Vexa.host is not obligated to retain data after termination.

8. Liability

  1. Limited Liability
    Vexa.host is not liable for:

    • Downtime or interruptions due to technical issues, maintenance, or force majeure
    • Loss of data or in-game progress
    • Any direct or indirect damages arising from using our services

  2. Maximum Liability
    Our total liability is limited to the amount paid for services in the 3 months preceding a claim.

  3. Legal Exceptions
    Nothing limits liability where prohibited by law, including gross negligence or intentional misconduct.

9. Changes to the Terms

  1. Modifications
    Vexa.host may update these Terms at any time. Updated versions will be posted on our website.

  2. Acceptance
    Continued use of our services constitutes acceptance of the updated Terms.

10. Governing Law and Jurisdiction

  1. Applicable Law
    These Terms are governed by Dutch law.

  2. Dispute Resolution
    Disputes will be resolved by the competent courts in the Netherlands.

  3. EU Compliance
    Services comply with applicable EU regulations, including consumer protection laws in France, Germany, and other member states.
